VOYAGE CREW CONDITIONS OF BOOKING

By submitting a booking form online, you (hereinafter “the Crew Member”) are entering into a contract with Tall Ships Limited (hereinafter “TSL”), and agreeing to accept a berth on the basis set out below. For any person under 18 years of age, the booking form must be completed by that person’s parent / guardian who will thereby accept these terms of the booking on behalf of both that person and themselves.

Your contract is governed by English law and any claim, dispute, or other matter arising under or in connection with the contract is subject to the exclusive jurisdiction of the English courts.

People wishing to sail as crew members should be fit and active. Due to the unique nature of the activities involved, the close living conditions onboard, the possibility of sleep deprivation and sea sickness, we reserve the right to exclude any person or to restrict any person to certain voyages where that person may be at risk on Health & Safety grounds by reason of their physical or mental health. Some medical conditions are associated with increased risk. We usually accept people with epilepsy provided they have had no fits for at least one year but may require further medical information before confirming this. People who are carriers of infectious diseases need to make us aware of their condition and in most cases are able to sail with us if no complications are present and they are fit to undertake a voyage. We do not recommend that women sail with us when pregnant.

A. Undertakings by TSL:

  1. The vessel will be under the command of a person holding the qualifications required by statute with additional professional crew as also required.
  2. The life-saving, safety and fire-fighting equipment carried on the vessel will conform with statutory requirements.
  3. Joining instructions will be forwarded approximately 8 weeks prior to commencement of the voyage and will give the date, time and place for joining and leaving the vessel.
  4. The fee paid covers berth and food onboard but not travel to/from the vessels.
  5. TSL reserves the right to cancel any voyage for reasons outside its control including (but not limited to) mechanical breakdown, bad weather or for reasons of safety. In the event of such cancellation, TSL will issue a credit note but shall otherwise have no further liability. TSL may also cancel any voyage for other operational reasons and will in such circumstances refund any voyage fee, port and fuel surcharges paid. TSL will give as much notice as is reasonably possible of any such cancellation.

B. Undertakings and Acknowledgement by Crew Member:

  1. I will be a member of the Voyage Crew and will sign on as such under current statutory regulations.
  2. I will be expected to carry out the duties assigned to me by the Master and Officers of the vessel.
  3. I will be required to make and pay for my own travel to/from the vessels.
  4. I agree to make a full declaration of any medical conditions or problems and medication used. (Information must be forwarded with Booking Form). I also agree to inform TSL if anything changes between booking and sailing
  5. I agree if required by TSL to obtain, at my own expense, a letter from my GP confirming fitness to undertake the voyage, in a form supplied by TSL. The letter may be mandatory for voyages involving deep sea sailing, and in other cases at the discretion of TSL.
  6. I agree to notify TSL in writing of any change in personal medical condition between booking and the start of the voyage.
  7. I agree that the Master (Captain) can authorise appropriate emergency medical treatment where necessary without recourse to next of kin and I agree to reimburse TSL for any expenses that are incurred.
  8. I will require a full passport for all voyages and I will consult my doctor for any foreign health requirements. I understand that if I do not have a valid passport and necessary travel documents I will be unable to sail.
  9. I understand that, on a voyage that is designated as being of mixed sexes, there are no segregated accommodation/sleeping facilities for Crew Members.
  10. I agree to the payment terms as follows:

Voyages priced £350 and above:

11. I agree to the following if I cancel my voyage:

56 days or less 100% of the voyage fee & any travel insurance premium paid

C. Crew Members aged 70-80 on 18-80, 12-80 or 16-80, aged 70-75 on 18-75 voyages and aged 60-65 on 18-65 voyages:

  1. Additional conditions of booking apply, details of which can be obtained from the Reservations Team on 023 9283 2055.

D. Liability:

  1. I understand that sailing can be a dangerous activity, particularly in rough weather, which can be encountered at any time on a voyage.
  2. I declare that TSL, its appointed agents and the Master and/or Officer and/or other crew of the vessels will have no responsibility for the vessel not fulfilling or completing the scheduled programme or voyage due to bad weather, mechanical breakdown of the vessel whilst at sea or any other reason beyond the control of TSL or any other person for whom TSL is legally responsible.
  3. I declare that TSL shall not be liable to me in any manner whatever (whether in the law of contract, tort, or otherwise) in respect of any loss, damage, or injury, whether direct, indirect, economic, consequential or of any other kind whatever, however arising out of or in connection with these Conditions of Booking, provided that nothing shall restrict TSL’s liability for death or personal injury resulting from its negligence.

E. Insurance:

Tall Ships Adventures are pleased to announce that we now automatically include travel insurance within your booking costs. This is to ensure that everyone sailing with us is insured with a suitable policy.

We have arranged this specialist travel insurance for all crew members taking part on all Voyages aboard any vessel owned or managed by Tall Ships Ltd.

General Exclusions that apply to all Sections

It is important to be aware that Trips booked or commenced contrary to Medical Advice, contrary to health and safety regulations of airlines, to obtain medical treatment or after a terminal prognosis has been made are excluded.

This insurance also excludes certain types of claim arising from any of the following conditions in respect of an insured person

(a) who is waiting for an operation or post operative check-up, any investigation or results, or any other hospital treatment or consultation (other than regular hospital check-ups for a stable condition where the medication and dosage has not changed in the last 12 months.)

(b) who has received treatment for any of the following during the 24 months prior to date of booking a trip:

a stroke, any form of cancer; leukaemia or tumour; a transplant; any heart problem; hypertension; dialysis; diabetes (not including diabetes II); any blood disorder; any breathing or respiratory problem (not including asthma, unless requiring inpatient treatment); any psychiatric illness or dementia; any gastro intestinal condition e.g. colitis, stomach ulcer; any neurological system related condition

(c) who has been seen by a specialist in the last three months (other than regular hospital check-ups for a stable condition where the medication and dosage remains unchanged).
